The U.S. Department of Labor has very vague rules regarding the timeframe within which employers have to pay former employees their final paycheck. Instead, the federal government leaves it up to the states to decide such deadlines.

West Virginia’s laws clearly state exactly when employers must pay former workers their final paycheck. Specifically, employers must pay workers:

  • Involuntarily terminated (someone who was fired or laid off) within three days.
  • Voluntarily terminated (someone who quit) during their next regular pay period
  • Unused vacation pay if specified in employee contract (not mandatory in some cases)
